Announcement on the Collection of Personal Data for Referral Returns

Effective today, Finest People will be adjusting their procedures in accordance to the Ministry of Manpower’s announcement on their website, which took effect in October 2020:

Under the revised Employment Agencies Licence Condition 5(b), employment agencies (EAs) are required to collect the personal data (e.g. NRIC, FIN) of applicants referred to employers for permanent or contract job positions of at least 6 months with a fixed monthly salary of $3,300 and above.

As stated in their announcement, Employment Agencies (referred to as EAs) will now be required to collect candidates’ information and consent before submitting their profiles for consideration for employment.

The collected information will include personal information such as the NRIC, FIN, or Passport numbers for candidates who have never worked or lived in Singapore.

This change applies to applicants referred to employers for both permanent and contract positions of at least 6 months, with a fixed monthly salary of $3,300 and above.

PDPA requirements on collection, use and disclosure of personal data are not applicable to EAs that are collecting such information, as it is a regulatory requirement.

As stated above, the collection of such personal data is considered a regulatory requirement, and as such is not subject to the Personal Data Protection Act’s requirements. Rest assured that the collected personal data is purely for providing the MOM proof and documentation of EA activities.

The PDPA requirements on collection, use, and disclosure of personal data do not apply to EA’s when collecting such information as it is a regulatory requirement.

With this in mind, EA’s should not share this collected information with any other parties, including their clients.
